Sally has been working at an engineering and infrastructure firm called ‘Florea’ for the
last 26 years. She is head supervising engineer of the company’s large infrastructure
projects. A major part of her job entails making site visits to ensure that projects are
running to schedule and on budget.
Three years ago, Sally was diagnosed with a rare blood condition. She was found to
have abnormally small red blood cells that do not carry enough oxygen. She
immediately informed her employers of her diagnosis. The condition makes Sally
extremely tired, especially after physical exertion.
Until 18 months ago, Sally continued to travel abroad to supervise work on the
company’s international projects. However, she now needs blood transfusions every
6 months in order to keep her iron at safe levels and so has declined to travel abroad
but continues to visit sites in the United Kingdom.
Flore’s human resource department (HR) has been very accommodating. Sally has
been given time off work to attend hospital appointments and is given a few days off
work after each blood transfusion in order to recover. HR have also allowed her to
work remotely when possible. Despite this, Sally feels pressured to keep up the
international site visits, as this is her primary supervisory role and she feels that she
is at risk of being demoted.
To add to her worries recently there has been a lot of friction between Sally and her
manager, Abdul. Abdul is concerned that Sally is not well enough to safely and
effectively carry out her duties. He has also expressed to Sally that she ought to
retire as she has had a long and successful 26 years at the company, and that it may
be time to “let the young ones in”. At their last meeting Abdul ‘jokingly’ told Sally that
she ought to “make space for the next generation” and “should consider getting a
disability badge to park at the allotment”.
One week ago, Sally received a letter from Abdul saying that he is commencing the
company’s performance management process and that she is at risk of dismissal on
the grounds of capacity if her performance does not improve. Abdul has spoken to
the HR department saying that he wishes to start the dismissal process against
Sally. Since receiving Abdul’s letter Sally is considering resigning.
Comment on the central legal issues and advise the human resource manager
