The Rule Explanation Paragraph is the building block of the legal argument. The purpose of a
Rule Explanation Paragraph is to explain what one court in one case says about one part of the
rule. In the Objective Memo, you will write four Rule Explanation Paragraphs. However, for this
assignment, you will only write one Rule Explanation Paragraph.
The textbook does not go into great detail about Rule Explanation Paragraphs; however, the
assigned article does. Please read the article before attempting this assignment. You should also
watch the Rule Explanation Paragraph video and read the Rule Explanation Paragraph
Assignments Prompt before attempting this assignment.
You will use Case #2 for this second Rule Explanation Paragraph. Write your Rule Explanation
Paragraph based on the rule for the exercise of physical control from that case. Do not provide
a case summary. Do not explain the whole rule for bailment – just one part: the exercise of
physical control.

Read the Wojcik article. Follow the second option described in the article for writing a Rule
Explanation Paragraph. Watch the Rule Explanation Paragraph video. Start the paragraph with a
sentence that explains the exercise of physical control. Then, cite the case from which you have
pulled the explanation (Case #2). In the next 3–4 sentences, state facts from the case that will
help you explain the rule. In the last 1-2 sentences, explain how the court applied that rule to the
facts to arrive at its conclusion on this part of the rule. Make sure to incorporate citations after
