LOWER COURT CASE

21-476 303 CREATIVE LLC V. ELENIS
DECISION BELOW: 6 F.4th 1160
LOWER COURT CASE NUMBER: 19-1413
QUESTION PRESENTED:
Artist Lorie Smith is a website designer who creates original, online content consistent with her faith. She plans to (1) design wedding websites promoting her understanding of marriage, and (2) post a statement explaining that she can only speak messages consistent with her faith. But the Colorado Anti-Discrimination Act (CADA) requires her to create custom websites celebrating same-sex marriage and prohibits her statement–even though Colorado stipulates that she “work[s] with all people regardless of … sexual orientation.” App.53a, 184a.
The Tenth Circuit applied strict scrutiny and astonishingly concluded that the government may, based on content and viewpoint, force Lorie to convey messages that violate her religious beliefs and restrict her from explaining her faith. The court also upheld CADA under Employment Division v. Smith, 494 U.S. 872 (1990), even though CADA creates a “gerrymander” where secular artists can decline to speak but religious artists cannot, meaning the government can compel its approved messages. The questions presented are:
1. Whether applying a public-accommodation law to compel an artist to speak or stay silent, contrary to the artist’s sincerely held religious beliefs, violates the Free Speech or Free Exercise Clauses of the First Amendment.
2. Whether a public-accommodation law that authorizes secular but not religious exemptions is generally applicable under Smith, and if so, whether this Court should overrule Smith.
GRANTED LIMITED TO THE FOLLOWING QUESTION: WHETHER APPLYING A PUBLIC-ACCOMMODATION LAW TO COMPEL AN ARTIST TO SPEAK OR STAY SILENT VIOLATES THE FREE SPEECH CLAUSE OF THE FIRST AMENDMENT.

Movie Analysis – Assignment Instructions
Objective: Students will show their knowledge of concepts and topics related to gender, sex, and sexuality and the relationship between gender and the family, educational systems, or the workplace by analyzing a movie of their choice from the list below.
Course Competencies:
Read with comprehension.
Make connections in learning across the disciplines and draw logical conclusions.
Demonstrate problem-solving through interpreting, analyzing, summarizing, and/or integrating a variety of materials.
Apply learning in academic, personal, and/or public situations.
Any of the other competencies depending upon the concepts and topics that they chose
Assignment:
Students are to write a 3-5 page movie critique in APA format with in text citations and APA reference page.
In this paper students are to create a clear introduction that states what movie they are critiquing, a summary of the movie and include a quote or something that they think may catch the readers’ eye. The introduction should present three or more gendered topics, concepts, or key points or themes that will be discussed in regards to the movie that was chosen. Examples of gendered topics, concepts, key points and themes include three or more of the following: gendered institutions such as the family, educational systems, the workplace, and religious contexts, culture, sexual scripts, gendered media, gender socialization, heterosexuality, homosexuality, intersectionality, nature v. nurture, power, femininity, masculinity, gender fluidity, doing gender, gender roles, gender stereotypes, etc…).
In the body, the student will develop a discussion of their position on each of three selected topics, concepts, or themes about which they are writing using examples from the movie to support their insights. State what you believe the movie has to say about gender, using evidence from the movie. Include events from the plot, descriptions of important scenes, and direct quotes from character dialogue to make your point. Don’t summarize the whole movie; rather, focus on the parts of it that are most important to your argument. Remember to also use your textbook to define terms and to support your thesis.
Here are a few things that you can discuss in the critique:
What gendered themes or topics related to politics does you think your movie deals with? Please see the topics in the chapter of your book covered this week (Chapter 10 and/or previous chapters).
How does your movie portray concepts, theories, or themes related to gender and politics that you have chosen? Are the stereotypical or accurate? Are they positive or negative? Do they poke fun of them? What kind of impression does this make about this group?
In what way does the movie distort or represent the gendered society of that period of time?
Are there any social concerns related to gender that are discussed or portrayed in the movies?
Select observations that are surprising or startling. A gendered movie analysis that makes unexpected observations will be much more interesting than one that focuses on obvious things.
These are not all encompassing. If you have an idea then ask. These are just a few suggestions.
Write a conclusion, restating your main thesis and showing how it relates to a broader gendered perspective. You may wish to reflect on the movie’s continued relevance to current events, for example or, if it is no longer relevant to our culture, discuss what has changed.

Analyzing Arguments Activity
In preparation of constructing your own argument, you are tasked this week with breaking down and analyzing a written argument to better understand how they are constructed and how they work.
1. Skim the following examples: 4.11.2: Sample Assessment- “Typography and Identity” – Humanities LibreTexts
Links to an external site.
and 10.8.1: Annotated Sample Visual Argument Analysis – Humanities LibreTexts.
Links to an external site.
Pay attention to the notes that have been added to the texts in parentheses, assessing the various steps that the authors’ take in making their arguments, such as summary, counterargument, inductive or deductive reasoning, evidence and what kinds of evidence, the premises, its sources, and any fallacies, as well as the organization of the argument.
2. Then find a recently published Op/Ed in order to conduct your own analysis. It is important to be able to recognize the difference between a “news” article, which should be an unbiased reporting of news events and facts and not offer the author’ opinion, and an “opinion” article in which the author(s) make a persuasive argument (often using evidence and facts) in favor of their opinion. You can find recent op/eds at the following links: Opinion – The New York Times (nytimes.com)
Links to an external site.
, Opinions (washingtonpost.com)
Links to an external site.
, or Opinion: Op-Eds, Editorials, and Political Commentary | The Hill
Links to an external site.
.
3. Emulate the argument assessment/analysis from Step 1. Copy/paste the Op/Ed’s text (and a link to the original source) into the text box and assess and evaluate the author’s argument by placing comments in bold and parentheses, (like this). Again, note the various steps that the authors’ take in making their arguments, such as summary, counterargument, inductive or deductive reasoning, evidence and what kinds of evidence, the premises, its sources, and any fallacies, as well as the organization of the argument.
4. Finally, evaluate the argument–was it effective? Why or why not? Name at least one suggestion to improve the argument.

For this short answer assignment, first choose a topic that interests you (for example, family, money, climate change, etc.). Next, select three creative works that portray this topic. One creative work should come from each humanities subject area (one work of visual art, one work of performing art, and one work of literary art).
You can find creative works from the three humanities subject areas in the textbook, on the internet, or anywhere else around you that has a creative work that portrays the topic you chose.
Specifically, you must address the following:
Three Creative Works
State the artist and title of each of the three creative works you selected, then explain your rationale for selecting the three creative works. Include the following in your response:
What do you connect to about each creative work?
What emotions does each work evoke in you?
One Work in Depth
Choose one of the works you selected and be sure to clearly state the artist and title, then explain how the work helps the audience make sense of the topic it portrays. Consider the following in your response:
What insights about the topic does the creative work convey to an audience?
How does experiencing this creative work help an audience understand more about this topic?
What to Submit
Submit your assignment as a one-page (or less) Microsoft Word document with 12-point Times New Roman font, double spacing, and one-inch margins. If sources are used, follow APA citation guidelines when citing sources both throughout and at the end of your paper.

The discussion post question we have to answer “In The Gender Code documentary, transgender director Luka Keating states that the only way to free ourselves from the oppressive systems of institutionalized gender and sexual roles in society is to change and revolutionize how we view gender and sexuality altogether to be more inclusive of trans and queer people, especially in the construction of the heteronormative “nuclear” family model. Referring directly to the reading and the documentary from class, describe how one gendered institution reinforces normative expectations of gender and how we might rethink this institution to be more inclusive.”
You have to watch and reference this documentary “Luka Keating,  The Gender Code (2019) (video)”

The course content explored how the sociological imagination, as developed by Mi

The course content explored how the sociological imagination, as developed by Mills in 1959, can be applied to the issue of victim-blaming in modern-day society. Relying on the article by Ghidina (2019) to frame the presentation of victim-blaming and the re-victimization of victims, an argument was made that both can occur within a societal framework that focuses on the dehumanization of certain subgroups of people. At the end of the presentation are listed the following four concepts: Dehumanization Lack of empathy for the “other” Victim-blaming Revictimization First, develop a working knowledge of these concepts. Then, for this discussion post, create a concept map in which you demonstrate a clear understanding of their meaning and how they are connected when it comes to the re-victimization of rape/sexual victims by the police during the initial interviewing process. What concept mapping is and the steps you will need to take to complete the assignment: A concept map is a visual representation of a topic that you can create using words, phrases, lines, and arrows to organize ideas and show your understanding of an idea, an issue, or an essential question. It involves the following steps: Step 1 involves a brainstorming session which ends in the jotting down of notes associated with the main issue or question. This should be accomplished by reviewing carefully the course content or any notes that you might have taken when first perusing that material. Step 2 requires you to see how these concepts that you have identified might be connected or linked together in some meaningful way. Continuing with the “pen or pencil to paper” process, sketch that out and organize it in a way that will allow you to take the final step in this process. Step 3 is the creation of the concept map using a software tool designed for that purpose. There are many free concept mapping software such as Mindmap.com
