Make sure you at least glance through Chapter 1 of the Dennis Baker book (The Right Not to be Criminalized) before answering these questions.
How do crimes become…criminal? Killing another person just because you dislike them – clearly should be prohibited. But what about prostitution, panhandling, and similar crimes?
This week we are going to look at decriminalization of prostitution and decriminalization of drug use. How are the goals of criminal law (the 5 basic goals which are incapacitation, rehabilitation, deterrence, retribution, and restitution, or some variety of these) reflected both in criminal statutes prohibiting prostitution and drug use, and in decriminalization of these two activities? Consider how other countries are dealing with these questions as well as how individual areas within the US are managing.

There are ethical challenges in every aspect of the criminal justice system. Administrators are responsible for setting the tone for ethical conduct in the administration and operation of their agency.
You are to assume the role of the head (Chief, Director, Warden, etc.) of a fictitious criminal justice agency; e.g., police department or sheriff’s office, local detention center (adult or juvenile) prosecutors’ office, trial court, probation agency, correctional institution, parole board, parole agency, etc.
As the head administrator, you decide it is in the best interest of your agency to have a policy that sets forth how the agency will operate in an ethical manner…. similar to a Code of Ethical Conduct
In your paper you are to describe in detail your plan to insure ethical practices in your selected agency.
How will your ethical policy be established? (Who will be involved in drafting the document? What resources will be drawn on or references? etc.)
How will it be communicated to the members of the agency to ensure awareness and adoption?
How will it be inspected to ensure compliance?
How will it be reinforced so that members of the agency clearly understand your seriousness?
NOTE: The content of your ethics policy or code is irrelevant and, but for clarification or reference purposes should not be included in this project paper. Instead, the paper should concentrate on your plan to create and Implement it.

The discussion is:
What is the “Burden of Proof” the State must prove in order for a defendant to be found guilty in a “criminal” trial? How does this burden differ from that of a “civil” trial? Do you think there should be a different burden for criminal vs civil?

Students will write a brief (1 page or so) My research question: Which types of DUI laws and their consequences have the most effect on preventing repeat offenders? This is to follow after a title page, the introduction and literature review. A proposed study section is written to go immediately before a to-be-written proposed method. In the proposed study section, students will clarify what the proposed study will be, clearly articulate the research question studied, and specify hypotheses for the proposed method. Hypotheses should make clear the main independent and dependent variables, as well as the relationship between those variables. Hypotheses should flow from the literature review, and make sense given what is already known for the topic. Students can also highlight the practical and theoretical significance of the proposed study in this section (e.g. what does it all mean and why is it important).

A point that is made in Ch. 3 of Self-control and crime over the life course (Hay and Meldrum) is that the history of self-control research arguably began with the “marshmallow experiments” conducted at Stanford University. In considering this aspect of self-control research history, please do two things.
First, drawing from Hay and Meldrum (2016), describe key things we have learned from the marshmallow experiments (including the research that followed up with marshmallow test participants later in life to see how they were doing).
Second, go to youtube.com and do a search for “marshmallow experiment” (or some similar such phrasing). You’ll see multiple videos that are roughly 2-5 minutes long and that include footage of actual marshmallow tests conducted with small children. View some of these, and describe whatever you see as noteworthy. Did the children succeed or not? Did they seem to find it easy or not so easy? What types of reactions did they have during the test? Again, I’m open to whatever you see as worth emphasizing. (And please copy and paste into your post the web address for your video(s)).

For this Project, you are to assume you are a judge for the Supreme Court of Maryland. You recently heard oral argument for the case of Adnan Syed v. Young Lee, as Victim’s Representative, et al. You were provided with the following multiple sources for background on the case by both sides:
Timeline—The Adnan Syed Case (New York Times)
Adnan Syed Ask Appeals Court to Deny Request from Victim’s Family (ABC News)
Adnan Syed Case: Brief Seeks to Uphold Ruling (WBALTV)
Adnan Syed’s Murder Conviction (WBALTV)
You have also reviewed the lower court’s decision causing this case to arise to the Supreme Court.
Required Analysis:
You have been asked to write a court opinion addressing the following legal questions about the Adnan Syed case:
Provide a brief overview of the facts of the case that was the subject of the Serial Podcast.
Was reasonable notice given to Mr. Lee (Haw Min Lee’s brother) by the Baltimore City prosecutor? If yes, why? If not, what would reasonable notice look like?
How does reasonable notice impact a victims’ ability to be present at a trial or hearing?
How does presence impact a victims’ ability to be heard?
Did the prosecutor in this case comply with Article 47 of the Maryland Constitution requiring, “A victim of crime shall be treated by agents of the State with dignity, respect, and sensitivity during all phases of the criminal justice process.” Why or why not?
What processes could have been established by the prosecutor’s office to ensure there was no question that Mr. Lee had been afforded all of his rights under Maryland law?
Who is ultimately responsible for the delays in this case resolving, the victim or the government? Explain your analysis here.
How has this cased illustrated the general public’s lack of understanding of the difference between compliance of victims’ rights (the concept that those obligated to afford the rights under the law do so) v. enforcement of the rights (the ability to seek redress through the courts when rights are violated)?
