2. Fat Foods, Inc. telephoned four orders to Lean Machine Company to
purchase Lean Machine’s low calorie sweetener. Lean Machine sent Fat Foods written confirmation of each oral order. Each written confirmation contained an arbitration clause requiring the parties to submit any disputes to arbitration rather than commence a lawsuit. Upon receipt of each written confirmation Fat Foods initialed the document as requested. Upon receipt of the confirmations Fat Foods objected to the inclusion of a clause by Lean Machine in the third and fourth confirmation that extended delivery to thirty days rather than fourteen days as contained in the first and second confirmations and, the delivery term was changed to suit Fat Foods. After receipt, Fat Foods discovered that the sweetener did not meet the contract specifications. Lean Machine disagreed and demanded that the dispute be submitted to arbitration for resolution. Fat Foods disagreed and brought this court action to stop the arbitration proceedings (seeking what is called an “injunction”). The trial court judge ruled that the arbitration clause was not part of the agreement between the parties, in effect ruling in favor of Fat Foods.

5. Pong Golf Ball Co. is one of the largest manufacturers of quality golf balls in
U.S. Recently, Pong introduced its new “Rocket” model golf ball. Pong has always been synonymous with excellence in golf balls. After learning about the new model and its limited first year production through Pong’s promotional literature, Fuzzy, the resident golf professional at Shady Acres Country Club contracted to purchase 200 dozen “Rocket” model golf balls from Pong. A contract for sale was executed which contained the following paragraph:

Fuzzy sent a check to Pong for $5,000. for the new golf balls. Hello everyone, I hope you are enjoying your week!
I am Vanessa, and I live in Phoenix, Arizona. I am currently completing an associate degree in Business Administration which should be completed by April 2024. I am married with five children, one who’s an adult, four teenagers, and two grandchildren and I just found out a third grandchild is on the way. I have been currently in a banking career at JP Morgan Chase for the last five years. I am going to school to provide a better education to better my career and to grow within the company. I also want to have my own business eventually, owning my own café with a community center for children to come and learn about life.  When our family is not busy with work, school, or activities we love to take trips to the beach, sporting events, and cooking together.  The type of business law I choose is employment law. Employment law will help the business and the employees with labor standards. An employee’s rights include work conditions, fair compensation, discrimination, health benefits, and disabilities.  This will allow the company to have standards when hiring or firing employees.

Hi class!
My name is Bailey. I am 24 and live in South Central Pennsylvania! I am pursuing a bachelor’s degree in business administration. I haven’t decided to concentrate on any specific area yet, as I’m not 100% certain where I want to go with my career just yet. Currently, I am interning for Volvo Construction Equipment as a Human Resources intern, where I have been for over a year! I would love to work for Volvo full-time upon graduating, as well as with the Human Resources team. Worst case scenario, I will certainly pursue an HR role for another international business, as I love the dynamics between all the employees from around the globe.
For this discussion, of course I will be choosing employment law! From the perspective of running a business, employment law provides a standard that a prospective employee can depend upon. They know going into a new position that they will be protected under these laws. Additionally, laws make communication between an employer and employee a lot easier. For example, a person under 18 (at least in the state of Pennsylvania to my knowledge) cannot begin working before 6:00 am. If either party has a question about this, the law here provides a clear answer. This is a very minor example, but it goes to show just how important employment laws are when running a business!
While it may seem to go against the points made above, these laws can sometimes interrupt or be very expensive to a business. For example, an employee who averages a certain number of hours a week is required to be offered benefits. Benefits of course come at a cost to the business.
Additionally, unions are generally good for society, but when demands become excessive and employees go on strike, the business is on hold until demands are either met, or employees quit.
