Introduction
There are some things which should have been included or tackled by the constitution that were not addressed. First and foremost the individuals who designed the constitution failed to capture or to acknowledge that some clauses could be a source of disaster in the future if were left out of as they were. Such clause included the proper and necessary clause that gave the congress excess powers.
Proposed government under the constitution
More over the Constitution did not address some contemptuous issues which could be used by a sitting president to victimize and manipulate the interests of the American people. The designers didn’t put into their minds about the interests of future generations, they only thought about power spreadsheets to the common person as far as Jack N. Rakove is concerned.
Even the most admired candidates by the countrymen were feared as they were seen and construed to develop disrespect due to power granted to them by the offices they held. From Madison’s contribution during the Federal Convention of 1887 it is clear that the government proposed by the proposed Constitution could be checked.
George Washington demanded that power should be given to one person, however this generated pressure among the people as they demanded power to be shared among the cabinet. As far as Washington was concerned the presidency as demanded by Hamilton was to serve the people without any opinion from the stakeholders and with overdue power to control all the arms of the government. He argued that proper consultations were not made during amendment of the constitution in allocating powers to the president. This is where he differs with Hamilton who argues that in the event of good governance all the powers should be granted to the president and the executive.
The constitution had not granted the people the authority to elect the president of their choice and this posed a great problem as people are supposed to elect the person whom they think will govern them well and effectively. A debate arose concerning the presidential election. The article explores possible problems under one presidential candidate. It notes that this would not allow voters a chance to compare hence culminating to monotony. The article further considers probable problems posed by two candidates in the event the winning candidate becomes president and his running mate becomes the vice president. Noting that the Vice President was the president’s opposer this would create tension in the government as the two principals were rivals and cohesion would not evolve as they were opposed to each other
The time president is to spend before ascending to the office was terrifying has it allowed the opponent to persuade him to abandon his social and economical reforms so that he will be able to use it as his campaigning tool in the forthcoming elections. This time also allowed the sitting president to waste the resources no matter how exotic it will turn to the other president as it turned to Clinton when Bush committed US troops to a military mission in Somalia which led to Clinton’s criticism from the rest of world though he had not played any major role in sending the troops. The voters were unable to account anything to their presidents as the constitution did not guarantee
The Constitution did not allow the president to be brought into books while in power thus many of them used their powers to manipulate and eradicate the resources in the country before living the office as it happened during the time of John Tyler. The Constitution did not grant the house enough powers to rebuke and throw personalities who didn’t act effectively out of the house instead granted the senate power to retain some individuals whom it thought they served it well without considering the interest of the public as it happened to the case of Andrew Johnson, whom it thought is ideas were valid and desirable.
Constitution should grant people the chance to give their opinions and views on how the government is running its activities without being victimized.
The constitution furthermore granted the presidents who were stubborn a no change arena but a good ground to continue with their stubbornness. It also grants the presidents’ successors a good go ahead with the predecessors’ activities and not to abolish them if they were not profitable. Professor Garret Epps when referring to Hamilton suggests that the constitution should be changed to allow citizens to elect their presidents directly and the president-elect to take charge of the office immediately, the president should also be granted limited powers, the citizens should be given a chance to oversee the operations of the executive and roles of the president should be clearly defined.
Conclusion
The changed constitution should allow the president to appoint cabinet ministers from both parties i.e. both sides side with the ministries well distributed and if unwilling should be ready to leave his office. He will then be succeeded by the vice president who would be able to align where the other president failed. The constitution should allow the president elect to assume the office immediately after being elected and the executive branch be divided to guard its abuse and absorb the powers withheld by the arms within the president and attorney general.
